The Hungarian national trademark system is more than 100 years old. Current trademark law has been in force since July 1997, quite some time after the political changes of 1990. This was primarily because trademark law was considered fairly modern when it was instituted in 1969, as it was uniquely market-oriented even at the time of the socialist regime and fulfilled its role even up to the early 1990s.
As Hungary prepares to join the EU, its legislation, including that dedicated to IP protection, is undergoing continuous adjustment. This explains the frequent amendments to the current trademark law. A final major package of amendments is expected to come out during the next year when the transitional rules regarding the extension of the community trademark system to Hungary will come to fruition.
These amendments will extend the territorial limits of exhaustion of rights from the current national limits to the whole European Union. It is not yet known whether the trademark opposition system will then be introduced or if the current system will remain in force, wherein the validity of national trademarks can only be questioned in a cancellation proceeding initiated against the trademark concerned.
